Scope of Application, Customer Information
These General Terms and Conditions (GTC) govern the contractual relationship between PETRONAX EUROPE GMBH and consumers who purchase products through our online shop. We do not accept any terms and conditions that contradict or deviate from our GTC.
Conclusion of Contract
Online offers on the internet constitute a non-binding invitation to you to order goods.
You can place one or more products in your shopping cart. During the ordering process, you enter your data and preferences regarding payment method, delivery terms, etc. Only by clicking the “Place Order” button do you submit a binding offer to conclude a purchase agreement.
We reserve the right to accept your offer within 5 business days by email confirmation. After this period, your offer is considered rejected and is no longer binding for you.
We save your order with the details of the concluded contract (e.g., product type, price, etc.).
As a registered customer, you can view your previous orders via your user account.
You can edit the entered data at any time before submitting your order. Further correction options will be displayed during the ordering process. You can also cancel the order process completely at any time by closing the browser window.
Prices and Shipping Costs
Unless otherwise stated, VAT is included in the item price. Shipping costs are borne by the buyer. Shipping costs are agreed upon at the time of purchase, unless otherwise specified during the ordering process. There is no minimum order value.
Payment Terms
The product price and shipping costs can be paid either by credit card when ordering via the website or by bank transfer within three days of purchase. Delivery will take place after receipt of payment in the bank account of PETRONAX EUROPE GMBH.
Delivery and Transfer of Risk
Items for which payment has been received in the bank account of PETRONAX EUROPE GMBH will be shipped within three business days. If an item is not in stock, its availability will be reviewed on a case-by-case basis.
Retention of Title
The purchased item remains our property until full payment has been received.
Warranty and Liability
We exclude liability for breaches of duty due to slight negligence, unless these breaches concern essential contractual obligations, injury to life, body or health, warranties, or claims under the Product Liability Act. This also applies to breaches of duty by our vicarious agents and legal representatives. Essential contractual obligations include, in particular, the obligation to deliver the goods and to transfer ownership thereof. Furthermore, we are obligated to deliver the goods to you free from material and legal defects.
We are liable in accordance with the law, except as provided below.
In cases of slight negligence, liability is limited to cases of injury to life or health or breach of material contractual obligations.
Liability for damage caused by negligence is limited to EUR 10,000.00 per insured event.
Participation in Dispute Resolution Proceedings
We are obligated to participate in dispute resolution proceedings before the following consumer arbitration board: General Consumer Arbitration Board of the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl, www.verbraucher-schlichter.de.
